Charitable Trust
All the Charitable Trusts/ NGOs are required to make necessary compliances under the provisions of the Indian Trust Act, 1882, the Income Tax Act, its Rules and Regulations and other relevant legislations. Under the amended provisions of the Income Tax Act,2021, a charitable trust needs to be very particular in filing the information since severe penalties have been laid down in the Income tax Act for non filling/ filling inaccurate particulars. General Compliances for all trusts are as follows:
- Registration u/s 12A of Income Tax Act to get benefit of exemptions available to a Charitable Trust.
- Registration u/s 80G of Income Tax Act to pass on the benefit of ‘50% or 100%’ exemption over the donations to the donors.
- FCRA Registration to enable the NGO to be eligible to get foreign donations.
- Filing of statement of Donations in the prescribed form before the close of the F.Y. incorporating complete details of the donations received by the trust.
- Fresh registrations of NGO as per the new provisions u/s 12AB of Income Tax Act.
